    A las Sociedades Pública de Economía Mixta se les conoce como SPEM, y son una figura que permite a los gobiernos municipales desarrollar proyectos junto a la empresa privada, sin embargo, el auditor Eric Gutierrez Desanti, mediante el informe 011-EA-AI-2022 del 29 de noviembre del 2022, informó al alcalde Johnny Araya Monge de varias irregularidades en estas alianzas.

    La primera sobre una SPEM para inmobiliaria e infraestructura adjudicada a Consorcio 2020, que tenía como objetivo desarrollar un proyecto de infraestructura para viviendas de clase media. Esta SPEM no reporta avances en su propósito original: infraestructura de vivienda para clase media, sus objetivos se modificaron en 2022 a un anteproyecto para nuevas oficinas municipales, sin mostrar progreso y habiendo recibido dineros, como señala el informe.

    Que la SPEM para inmobiliaria y Estructura, fue adjudicada al Consorcio 2020, mediante acuerdo 12, Articulo IV, de la Sesión Ordinaria N°188 del 3 de diciembre del 2019; no obstante, su constitución se finiquitó un año después con pacto constitutivo y cedula Jurídica el 18 de diciembre 2020. Se giraron los dineros correspondientes por parte de la Municipalidad y a la fecha finalizando el año 2022 la estrategia del Plan de Desarrollo Municipal sobre “Brindar opciones de vivienda, para clase media del cantón mediante el funcionamiento de la Inmobiliaria e Infraestructura San José SPEM. La cual tuvo
    modificación en el 2022 a: Infraestructura: Contar con el anteproyecto definido y avalado por la SPEM, Anteproyecto para la construcción y administración de nuevas oficinas municipales. Supuestos responsables: Gerencia de Provisión de Servicios.” No reporta avances importantes en los informes de evaluación.

    Otra SPEM del informe, la SPEM CT&T-24 adjudicada a TCD Technological Cities Development S.A. ha recibido cédula jurídica pero no ha recibido aportes de capital, no se menciona en el Plan de desarrollo Municipal 2020-2024 y no cuenta con objetivos, es únicamente un cascarón vacío.

    Que la SPEM CT&T-24 fue adjudicada a TCD TECNOLOGICAL CITIES DEVELOPMENT S.A mediante acuerdo 17, Articulo IV, de la Sesión Ordinaria N°186 del 19 de noviembre del 2019; no obstante, su constitución se finiquitó con pacto constitutivo y cedula Jurídica un año después, el 26 de octubre de 2021 y a la fecha no se visualizan los aportes de capital de las partes, ni se visualiza en el Plan de desarrollo Municipal PDM 2020-2024 estrategias y metas relacionadas con la citada SPEM.

    Finalmente, el informe señala al SPEM RIZOMA se adjudicó a la empresa TECHNERGY, cuyo objetivo era el desarrollo de un Hub de Innovación, fue constituida en una escritura en octubre del 2022, sin que exista un acta del Concejo Municipal que la haya autorizado, y sin que aparezca otra acta del Concejo Municipal que autorizara al alcalde Johnny Araya a constituirla. Lo más curioso, es que dicha SPEM alquilaba un edificio y consumía servicios públicos desde el 2019 (por un costo anual de 46,800 dólares estadounidenses), incluso antes de estar inscrita.

    También, llama la atención que, previó a la adjudicación de la Contratación Directa a la empresa a TECHNERGY; y previo a que se recibiera el acta Constitutiva el 28 de octubre 2022; Se había emitido el oficio N° DDA-00398-2019 del 14 de Noviembre del 2019, por parte del encargado del Despacho del Alcalde para que el Departamento de Proveeduría contratara directamente basado en el artículo 139 de la Ley General de Contratación Administrativa el arrendamiento de un edificio por tres periodos con un costo anual de 46,800 dólares, vinculada al HUB de Innovación, la finalidad que se buscada con dicho arrendamiento “es poder desarrollar el proyecto de Ciudad Tec al poner en funcionamiento el Hub de Innovación..”. De lo anterior, existe el procedimiento N° 2019CD-001926-
    0015499999 con dos prórrogas en SICOP denominados “Servicio de Alquiler de establecimiento para oficinas del Hub de innovación”; desde el año 2019. Este alquiler se ubica en un edificio, frente al Edificio Figueres, sobre el cual se cancelan alquileres y servicios públicos; sin que la SPEM estuviera habilitada formalmente para funcionar.

    ¿Cómo puede ser que el sempiterno Alcalde de San José, jerarca municipal de San José desde 1991, primero como ejecutivo municipal hasta 1998 y posteriormente como alcalde, desconozca fundamentos de la administración pública y cree SPEM fantasmas a espaldas del Concejo Municipal, las cuales consumen recursos de la Municipalidad y no han tenido ningún resultado?
